General Terms and Conditions of Sale
These terms and conditions (“the Terms”) govern all sales of bagged cement (“the Products”) by Cementis (Mauritius) Ltd (“Seller”) unless specific written terms are agreed upon between the Seller and the Customer (“You”).

Application
These Terms apply to any order you make as a registered customer on our e-commerce platform (shop.cementis.mu). Our Terms may be amended from time to time, and you should therefore read carefully the text contained in this document each time you make a new order as for each new order, you will be concluding a new contract with us.

Transfer of Ownership and Risk
Ownership of the product transfers to the Customer upon full payment. Risk of loss or damage transfers to the Customer upon delivery to the Customer or their authorized representative at the Cementis (Mauritius) Ltd terminal or depot.

Stock Availability
All sales are subject to stock availability.

Price
Price is based on current government price controls and may change if the government revises these controls. Any changes to the price will be communicated promptly and will be applicable from the date of such government review.

Return and Refunds
Customers are required to inspect the condition and conformity of products at the time of delivery or collection, and before unloading of the goods.
Returns or refunds are only applicable in cases where products are found to be defective. If a product is found to be defective, please notify us by email at shoponline@cementis.io within 24 hours, including details of the product and the defect.
Upon validation of the defect, we will replace the item at no additional cost. After the 24-hour period, goods are considered non-exchangeable. Returned goods must be in their original and unused condition.

Delivery
Delivery is available within Mauritius only. We will make our best efforts to complete delivery within two (2) working days from the date of order confirmation. Please note that all delivery dates and times are estimates and may be subject to change due to logistical or courier delays, high order volumes during peak periods or holidays, adverse weather or unforeseen circumstances, product availability or stock replenishment or delivery location constraints or access issues.
The Seller is not liable for delays caused by events beyond its control, including but not limited to force majeure events.
The delivery point must be accessible within three (3) metres of the truck. For health and safety reasons, customers must ensure that the delivery area is free from obstacles and hazards.
If these conditions are not met, Cementis reserves the right to postpone the delivery until a safe alternative is identified.

Force Majeure
In cases of force majeure (unforeseen circumstances beyond our control), Cementis reserves the right to cancel or postpone delivery. Our team will inform you of any delays, and we commit to resuming deliveries as soon as conditions allow.
If you wish to cancel an order after payment but before scheduling of delivery, please contact us at shoponline@cementis.io or call 4652210. Our team will assess your request and advise on the possibility of rescheduling. If you choose to proceed with cancellation, a refund process will be initiated, which may take up to three (3) weeks, subject to coordination with payment partners and necessary approvals.

Limitation of Liability
The Seller’s liability for defective products is limited to replacement or refund of the defective product. The Seller is not liable for indirect, incidental, or consequential damages arising from the sale.

Payment Terms
We do not accept credit card payments. All transactions must be made via MCB Juice, or Emtel Blink.
Payments are processed through a secure MIPS payment gateway in partnership with our trusted financial service providers.

Dispute Resolution
In the event of any dissatisfaction with our services, the Client shall first notify our Customer Service by email shoponline@cementis.io. If the issue remains unresolved, the Client shall escalate the matter by sending a certified letter at the address specified in the contact details to our General Manager stating the nature of the complaint and any non-performance.
If the dispute is still not resolved after sixty days, both parties agree to attempt to resolve the matter amicably through direct negotiations.

Confidentiality
All terms and conditions, as well as details of the transaction, are confidential and may not be disclosed to third parties without prior written consent.

Governing Law
These terms and conditions are governed by the laws of Mauritius, and any legal proceedings shall be subject to the exclusive jurisdiction of Mauritian courts.
